ARTICLE 1 – PURPOSE
Fret4You, a freight forwarder, organizes and arranges, in its own name and on behalf of its clients, all transport operations by air, sea, road or multimodal means, as well as all related logistics services or customs formalities. These T&Cs are established in accordance with the professional practices defined by the TLF Federation and apply to all services performed by Fret4You.
ARTICLE 2 – SCOPE OF APPLICATION
These T&Cs apply to any service performed by Fret4You. Any order implies the client’s full and unconditional acceptance of these terms, unless an express written derogation is accepted by Fret4You.
ARTICLE 3 – OBLIGATIONS OF FRET4YOU
Fret4You undertakes to arrange transport diligently and in accordance with the instructions received. As a freight forwarder, Fret4You is free to choose carriers and intermediaries while ensuring their solvency and reliability.
ARTICLE 4 – CLIENT OBLIGATIONS
The client undertakes to provide all accurate information regarding the goods (nature, weight, dimensions, packaging, specific regulations, dangerous or sensitive goods). The client must provide in due time all documents required for transport and formalities (invoices, customs documents, licenses, certificates) and settle invoices under the agreed payment terms. The client is solely responsible for the consequences of any inaccurate, incomplete or late declaration.
ARTICLE 5 – LIABILITY AND LIMITS
Fret4You’s liability is strictly limited to that provided for under the applicable legal regimes: International road transport: CMR Convention (8.33 SDR/kg). Air transport: Montreal Convention (22 SDR/kg). Maritime transport: Hamburg Rules or Hague–Visby Rules (2 SDR/kg or 666.67 SDR/package). Domestic transport: pursuant to the French Transport Code. In no event shall Fret4You’s liability exceed these limitations.
ARTICLE 6 – INSURANCE
Fret4You is not obligated to insure the goods. At the client’s express written request, Fret4You may take out ad valorem insurance covering the actual value of the goods, at the client’s expense.
ARTICLE 7 – FINANCIAL TERMS
Invoices are payable within 30 days from invoice date, without discount. Any late payment entails, by operation of law: late-payment interest calculated at the ECB base rate plus 10 percentage points, and a fixed recovery fee of €40 (Art. L441-10 of the French Commercial Code). Fret4You has a lien and contractual pledge over all goods carried to secure payment of amounts due.
ARTICLE 8 – CLAIMS
In the event of damage, loss or delay, the client must issue specific and substantiated reservations within the legal deadlines: 3 business days for domestic road transport, 14 days for air transport, 3 days for maritime transport. No claim will be admissible if these deadlines are not observed.
ARTICLE 9 – FORCE MAJEURE
Fret4You shall not be held liable in cases of force majeure or events beyond its control (strikes, blockages, adverse weather, wars, pandemics, customs restrictions, etc.).
ARTICLE 10 – GOVERNING LAW AND JURISDICTION
These T&Cs are governed by French law. Any dispute shall fall under the exclusive jurisdiction of the Commercial Court of Paris.
